A Monster Trade Dress Win for Monster Truck Company

There was good news for those companies that have products with unique designs at the US Patent and Trademark Office (PTO). The PTO found that the design of a monster truck could be protected and registered as trade dress for the “services” offered by the owner.

Frankish Enterprises Ltd. (Frankish) is the proprietor of monster truck entertainment services offered in connection with its JURASSIC ATTACK monster truck (shown right).

Believing the design of its JURASSIC ATTACK truck was unique and functioned as a trademark, Frankish filed an application for the mark covering “entertainment services, namely, performing and competing in motor sports events in the nature of monster truck exhibitions.”

Fight On, Fight On? USPTO Cancels Six WASHINGTON REDSKINS Trademarks

Yesterday, the Trademark Trial and Appeal Board (TTAB) of the US Patent & Trademark Office (USPTO) cancelled six registrations related to the Washington Redskins professional football team. The TTAB found the marks violated Section 2(a) of the Federal Lanham Act, which bars registration of trademarks that may disparage persons or bring them into contempt or disrepute.

While this is a setback for Pro Football, Inc., the owner of the WASHINGTON REDSKINS trademarks, it is certainly not the end of the story. The team has already announced that it will appeal the decision to federal court. Furthermore, the TTAB decision only covers the right to register the trademarks. It does not impact the team’s right to use the trademarks, nor does it impact the team’s common law trademark rights, which are based on use of the marks in commerce.

Impending Launch of .CLOTHING and Other Fashion-Related gTLDs: Is Your Company Prepared?

As you may have heard, we are on the verge of a vast expansion of the Internet. Currently, there are only about two dozen generic top-level domains (“gTLDs”), such as .com, .net, and .info. However, there will soon be more than 1,000 new gTLDs, many of which are relevant to companies in the fashion and luxury goods industries. For example, third parties have applied for the right to operate .clothing and .fashion as new gTLDs. Other notable applications include .beauty, .boutique, .buy, .design, .home, .life, .lifestyle, .living, .luxe, .luxury, .sale, .shoes, .shop, .shopping, .store, and .style. Finally, a handful of premier fashion brands opted to apply for the exclusive right to operate the gTLD matching their brand, including .cartier, .chanel, .gucci, .hermes, and .tiffany, and some department stores also choose to apply for their brands, such as .bloomingdales.
